Kent County Boards and CommitteesCommunity Center Authority : (Term 3 years ) Expiration of term
Code Home Rule Bill # 2-2005, adopted June 7, 2005, made effective on July 22, 2005 for creation of Community Center Authority. §14-2. Membership; terms; vacancies. A. The Community Center Authority shall consist of no more than twenty one (21) members appointed by the County Commissioners. The members shall be selected, as far as it is practical, with due regard to representation of all segments of Kent County’s population and to all geographic portions of the county’s area. B. At least one member shall be a County Commissioner, whose term shall be one year and may be reappointed, and at least one member shall be a board of education member, whose term shall be one year and may be reappointed. C. All other members shall be appointed for three (3) years from the first day of January of the year of their appointments or until their successors are appointed. The original members of the Community Center Authority, when first appointed, shall be divided into three (3) classes. The initial terms of those in the first class shall be three (3) years; of those in the second class, two (2) years; and those in the third class, one (1) year. D. Vacancies, except those at the expiration of a term, shall be filled in the same manner as the original appointments and for the unexpired term. §14-3. Officers. Officers of the Community Center Authority shall be a Chair, a Vice Chair, a Secretary and a Treasurer, all of whom shall be elected from among the Community Center Authority’s membership at the organizational meeting in July. The terms of officers shall be two (2) years or until a successor shall be elected and qualified. The duties of officers shall be set forth in the bylaws for the Community Center Authority. §14-4. Quorum. A quorum of the Community Center Authority shall be a two-thirds (2/3) majority of all appointed members thereof. §14-5. Personnel. The Community Center Authority, subject to the approval of the County Commissioners, may from time to time employ or contract with such personnel as they may consider necessary to properly administer the functions of the Community Center Authority. §14-6. Duties and responsibilities. The Community Center Authority, subject to budgetary policies, appropriations and approval of the County Commissioners, shall be responsible for planning, organizing, coordinating and administering a comprehensive community center campus, related facilities and programs, and shall be vested with authority to: A. Further the public interest, understanding and appreciation of the benefits of an intergenerational community campus, facilities and programs on cultural, social, recreational, fitness and therapeutic opportunities and community well-being. B. Oversee the planning, design, location, construction, equipping, maintenance and use of a comprehensive community center and related facilities within a community campus environment. C. Plan, develop, coordinate, supervise and promote community campus and community center-based programming and services; D. Employ an administrative director and other personnel and/or coordinate personnel resources and support among stakeholder organizations, subject to the provisions of §xx-5. E. Establish and promulgate facility policies, rules and regulations; including the setting of facility use and program participation fees. F. Join or cooperate with the federal government, the State of Maryland or with one or more counties, municipal corporations, or with one or more community organizations, or with the board of education, or any other designated agency, department or board in acquiring, leasing, providing, establishing, and maintaining facilities, fundraising, and conducting or coordinating programs. G. Develop, implement and coordinate a fundraising program for purposes of capital, operational, maintenance and endowment support, and the sustainability of Community Center Authority facilities, projects and programs. H. Acquire and receive property of all kinds, by bequest, gift, loan or lease, for public use I. Establish subcommittees, community based advisory committees or focus groups comprised of members and non-members for the purpose of enlisting expertise, ensuring public input and fostering collaboration. J. Foster partnerships between the public and private sectors in furtherance of the Community Center Authority’s duties and responsibilities. K. Establish bylaws for its governance and conduct of business, and adopt rules and regulations governing use and access to Community Center Authority programs and facilities. L. Submit to the County Commissioners an annual report of the Community Center Authority’s activities, together with recommendations for further activities and development of Community Center Authority facilities and programs, and submit any other reports or documents pertaining to the duties of the Community Center Authority as may from time to time be requested by the County Commissioners. The annual report to the County Commissioners shall include commentary and recommendations concerning the organizational structure, membership and governance of the Community Center Authority as such aspects relate to fundraising and the formation of effective private/public partnerships. M. Perform any other duties as may from time to time be assigned by the County Commissioners. §14-7. Supervision and removal from office. The members of the Community Center Authority shall be under the direction of the County Commissioners and shall be subject to removal by the County Commissioners. §14-8. Compensation. The members of the Community Center Authority shall serve without compensation but shall be reimbursed for such expenses incurred in the performance if their duties as may be approved by the County Commissioners. §14-9. Scope of Community Center Authority programs. The Community Center Authority may join or cooperate with the federal government, the State of Maryland, Kent County, any municipality, or any other governmental agency, individual, corporation, not-for-profit organization or citizen group in fulfilling its duties and responsibilities under this chapter. §14-10.Rules and regulations. The Community Center Authority is authorized to adopt rules and regulations governing access and use of facilities and programs under their control. Such rules and regulations shall be appropriately promulgated by the Community Center Authority. SECTION 2. The title of this public local law shall be deemed to be, and is, a fair summary of this public local law for publication and all other purposes. SECTION 3. This public local law shall take effect on July 22, 2005.
