Code Home Rule Bill No. 8-2001
A Public Hearing was held on Tuesday, June 26, 2001, at 10:00 a.m.
in the County Commissioners' Hearing Room, County Government Center,
Chestertown, Maryland on Code Home Rule Bill No. 8-2001 which is: an
Act to repeal and reenact with amendments to Chapter 210 of the Code
of Public Local Laws of Kent County (1994 Edition) title "Stormwater
Management", to comply with the requirements set forth in the 2000 Maryland
Stormwater Design Manual, Volumes I and II, Strengthening Stormwater
Controls and Management.
County
Commissioners Ronald H. Fithian, Larry B. Beck and W. Michael Newnam
were in attendance as well as Gail Owings, Director, Planning and Zoning
Administration, and members of the media.
Notice of the public hearing was read
into the record by Commissioner Fithian.
Commissioner Fithian read correspondence
received from the Planning Commission recommending approval of the Draft
Stormwater Management Ordinance and that the Ordinance meets the minimum
requirements for stormwater management as set forth in the 2000 Maryland
Stormwater Design Manual as well as exceeds the minimum requirements
in following sections:
Exempts only normally accepted agricultural
land management activities. Large agricultural structures will require
stormwater review. The Natural Resources Conservation Service will prepare
stormwater plans on farms as may be required. This is consistent with
the existing Ordinance.
Does not include an exemption for parcels
over two acres. This is consistent with the existing Ordinance.

Requirement
Continues to require quantity control
for the ten year frequency storm. The Design Manual permits counties
on the Eastern Shore to manage stormwater for the two year frequency
storm event.
Mrs. Owings advised that the State adopted
new stormwater regulations and the local law is being updated to reflect
those changes. She reported that the regulations would not have a significant
impact to the community.
There was no one in attendance who wished
to speak for or against this proposed legislation.
The third reading of this proposed legislation
will be held on Tuesday, July 3, 2001, the next legislative day.
