KENT COUNTY, MARYLAND


Board of License Commissioners

December 9, 2003

The Honorable Board of License Commissioners met today with the following present: Roy W. Crow, Scott D. Livie, and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, was also in attendance.

LEWES DAIRY MARKET

A public hearing was held at 9:40 a.m. on the application received from Mahmood Baig Mirza, President, Thomas M. Parks, III, Assistant Secretary, Karshif Mughal, Treasurer, and Hena Mahmood, Secretary, representing Gulshan, Inc. for an application for an upgrade to a Beer, Wine, and Liquor License, Class A, off sale only. Susanne Hayman, County Attorney, Mr. Mirza and his attorney, Alexander D. Burt III. Esq. were in attendance.

Ms. Hayman read the notice of the public hearing into the record.

Messrs. Stetson, Mirza, and Burt were sworn in by Ms. Hayman for giving testimony.

Mr. Burt s statement included a brief history of the current ownership of the Lewes Dairy Market and a statement that there were no problems during the ownership of the Beer and Wine License.

Mr. Stetson reported that during the current ownership of Lewes Dairy Market, there have been relatively few infractions, the only violation of alcoholic beverage laws being an incident in which there was no certified personnel on the premises during one of Mr. Stetson's inspections. Mr. Stetson also reported that the closest retailers of alcohol to Lewes Dairy Market are all at least one-half mile away. He underscored that the application in question is for an upgrade and does not involve a change in address or change in license-ownership.

There was no one present to speak for or against this application.

A motion was made by Commissioner Livie, seconded by Commissioner Crow, and made unanimous by Commissioner Pickrum to approve the application.

This hearing was taped for reference and adjourned at 9:50 a.m.


CJ'S

A public hearing was held at 9:50 a.m. on the application received from Connie M. Dadds and Jack D. Dadds, Jr. for a Beer, Wine, and Liquor License, Class D, on and off sale. Mr. and Mrs. Dadds and Susanne Hayman, County Attorney, were in attendance.

Ms. Hayman read the notice of the public hearing into the record.

Mr. and Mrs. Dadds and Mr. Stetson were sworn in by Ms. Hayman for giving testimony.

Ms. Hayman asked Mr. and Mrs. Dadds to respond to the rationale for their request for the license in question, to which Mr. Dadd indicated that his wife has had a reputable employment history as an operator of a tavern for many years, and that they are anticipating the purchase of the property which was formerly known as "Hawk-Eye's" in the near future.

Mr. Stetson stated that ownership of the said license would not change the character of the tavern, and that there are no other taverns in the community of Golts other than CJ's. Further, Mr. Stetson pointed out that Mrs. Dadds has been a tavern owner for many years, and that he knew of no violations involving Mr. and Mrs. Dadds.

There was no one present to speak for or against this application.

A motion was made by Commissioner Crow, seconded by Commissioner Livie, and made unanimous by Commissioner Pickrum to approve this application.

This hearing was taped for reference and adjourned at 9:55 a.m.

There being no further business to claim their attention, the Board adjourned to meet again on Tuesday, December 16, 2003.
