CHR5-2014 Marine Uses in Village District Legislat

INTRODUCED BY: William W. Pickrum, Member Board of County Commissioners for Kent County, Maryland.

AN ACT to amend Article V, Section 7.2 (Village District Permitted Uses and Structures), of the Kent County Land Use Ordinance by adding the following permitted uses: marine supply store including indoor outboard motor sales, subject to site plan review; new and used boat sales, boat and outboard motor repairs and boat storage, subject to limitations; and up to 30 self-storage units in 1 building not to exceed 100 square feet of floor space per unit, subject to site plan review; the property shall front on 2 public roads.

PUBLIC HEARING

HAVING been posted and notice of time and place of hearing and copies having been made available to the public and the press, a public hearing was held on July 22, 2014. Reported favorably [with] [without] amendments; read second time and ordered to be considered on August 5, 2014, a legislative session day.


A BILL ENTITLED

AN ACT to amend Article V, Section 7.2, Village District Permitted Uses and Structures, of the Kent County Land Use Ordinance by adding the following permitted uses: marine supply store including indoor outboard motor sales, subject to site plan review; new and used boat sales, boat and outboard motor repairs and boat storage, subject to limitations; and up to 30 self-storage units in 1 building not to exceed 100 square feet of floor space per unit, subject to site plan review; the property shall front on 2 public roads.

Article V, SECTION 7.2 VILLAGE DISTRICT (PERMITTED PRINCIPAL USES AND STRUCTURES

23. MARINE SUPPLY STORE INCLUDING INDOOR OUTBOARD MOTOR SALES, SUBJECT TO SITE PLAN REVIEW.

24. NEW AND USED BOAT SALES, BOAT AND OUTBOARD MOTOR REPAIRS AND BOAT STORAGE, SUBJECT TO THE FOLLOWING LIMITATIONS:
A. THE PROPERTY SHALL FRONT ON 2 PUBLIC ROADS.
B. ALL REPAIRS ARE CONDUCTED INSIDE A BUILDING.
C. THE STORAGE AREA AND REPAIR ACCESS AREA SHALL BE SCREENED ON ALL SIDES WITH WOOD FENCING A MINIMUM OF 6 FEET IN HEIGHT.
D. THE REPAIR SHOP BUILDING AND THE STORAGE AND REPAIR ACCESS AREA SHALL BE SET BACK AT LEAST 100 FEET FROM ADJACENT PROPERTIES THAT ARE ZONED FOR RESIDENTIAL USE.
E. THE OPEN AREA FOR DISPLAY OF BOATS SHALL BE LIMITED TO 3,000 SQUARE FEET IN SIZE.
F. THIS USE SUBJECT TO SITE PLAN REVIEW.

25. UP TO 30 SELF-STORAGE UNITS IN 1 BUILDING NOT TO EXCEED 100 SQUARE FEET OF FLOOR SPACE PER UNIT, SUBJECT TO SITE PLAN REVIEW. THE PROPERTY SHALL FRONT ON 2 PUBLIC ROADS.



















BE IT FURTHER ENACTED by the County Commissioners of Kent County that this Act shall take effect on the _15_ day of _August___, 2014.
