KENT COUNTY, MARYLAND

The Honorable Board of License Commissioners met today with the following present: Larry B. Beck, W. Michael Newnam, and Ronald H. Fithian, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the following issues:

SPECIAL LICENSE

The Commissioners approved the following one day only special licenses:

A Class C Beer License for Congressman Gilchrest fund raising event to be held at Turners Creek Park on June 20.

A Class C Beer License for Party on the Bay festival to be held at the Bayside Public Landing on August 17.

OLD OARS INN

Mr. Stetson advised that the licensee had requested a change in premise by selling soft drinks and beer on the side walk outside of the establishment. Since the request is a change in the license premise, the matter needs to approved by the Commissioners. A motion was made by Commissioner Newnam, seconded by Commissioner Beck, and made unanimous by Commissioner Fithian to deny the request for the sale of any alcoholic beverage outside the current license premise.

ALCOHOLIC BEVERAGE VIOLATION
COUNTRY LIQUORS

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the alcoholic beverage violations. After reviewing testimony given at the June 18 Administrative Hearing, the Commissioners determined that on May 22, a violation occurred to Article 2B, Section 12-108 of the Annotated Code of Maryland at Country Liquors, a licensed establishment, for the selling of alcoholic beverages to a minor. This is the first violation for the current licensee during the past seven years involving this place of business. A motion was made by Commissioner Newnam, seconded by Commissioner Beck and made unanimous by Commissioner Fithian to impose a fine in the amount of $100 as well as to suspend the license for three (3) days in accordance with Article 2B, Section 16-507(p) of the Annotated Code of Maryland, however, twelve (12) days of the fifteen day (15) day suspension were waived. Mr. Desai, licensee, will be advised that his license will be suspended on July 15, 16 and 17, 2002.

ALCOHOLIC BEVERAGE VIOLATION
C'TOWN LIQUORS AND DELI

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the alcoholic

beverage violations. After reviewing testimony given at the June 18 Administrative Hearing, the Commissioners determined that on May 23, a violation occurred to Article 2B, Section 12-108 of the Annotated Code of Maryland at Country Liquors, a licensed establishment, for the selling of alcoholic beverages to a minor. This is the second violation for the current licensee during the past seven years involving this place of business. A motion was made by Commissioner Newnam, seconded by Commissioner Beck and made unanimous by Commissioner Fithian to impose a fine in the amount of $300 as well as to suspend the license for thirty (30) days in accordance with Article 2B, Section 16-507(p) of the Annotated Code of Maryland, however, twenty-seven (27) days of the thirty day (30) day suspension were waived. Mr. Krastel, licensee, will be advised that his license will be suspended on July 15, 16 and 17, 2002.

ALCOHOLIC BEVERAGE VIOLATION
GALENA MINI MART

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the alcoholic beverage violations. After reviewing testimony given at the June 18 Administrative Hearing, the Commissioners determined that on May 22, a violation occurred to Article 2B, Section 12-108 of the Annotated Code of Maryland at Galena Mini Mart, a licensed establishment, for the selling of alcoholic beverages to a minor. This is the first violation for the current licensee during the past seven years involving this place of business. A motion was made by Commissioner Newnam, seconded by Commissioner Beck and made unanimous by Commissioner Fithian to impose a fine in the amount of $100 as well as to suspend the license for three (3) days in accordance with Article 2B, Section 16-507(p) of the Annotated Code of Maryland, however, twelve (12) days of the fifteen day (15) day suspension were waived. Mr. Dusia, licensee, will be advised that his license will be suspended on July 15, 16 and 17, 2002.

ALCOHOLIC BEVERAGE VIOLATION
MILLINGTON PIZZA

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the alcoholic beverage violations. After reviewing testimony given at the June 18 Administrative Hearing, the Commissioners determined that on May 22, a violation occurred to Article 2B, Section 12-108 of the Annotated Code of Maryland at Millington Pizza, a licensed establishment, for the selling of alcoholic beverages to a minor. This is the first violation for the current licensee during the past seven years involving this place of business. A motion was made by Commissioner Newnam, seconded by Commissioner Beck and made unanimous by Commissioner Fithian to impose a fine in the amount of $100 as well as to suspend the license for three (3) days in accordance with Article 2B, Section 16-507(p) of the Annotated Code of Maryland, however, twelve (12) days of the fifteen day (15) day suspension were waived. Mrs. Pectielidas, licensee, will be advised that her license will be suspended on July 15, 16 and 17, 2002.

WINE TASTING

In response to a request to have wine tasting on a licensed premise, Mr. Stetson requested a written interpretation for the Comptroller's Office on this matter. Mr. Stetson was advised that a Class 4 Winery can bring alcoholic beverage products onto a retailed license premise for bonafide promotional events and is subject to restrictions in the law. The State is not responsible for issuing winery licenses and regulating the activities of winery license holders. At Mr. Stetson's recommendation, the Commissioners approved to establish a policy whereby any licensee planning a wine tasting event is to provide this office with two weeks notice.

There being no further business to claim their attention, the Board adjourned to meet again on Tuesday, July 9, 2002.
