KENT COUNTY, MARYLAND

The Honorable Board of License Commissioners met today with the following present: Larry B. Beck, W. Michael Newnam, and Ronald H. Fithian, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the following issues:

SPECIAL LICENSE

The Commissioners approved a one day Special Class C Beer Wine and Liquor License for the Radcliffe Creek School Fund-raising Committee for an event to be held on November 11 at the school.

THE TAILGATE MARKET

A public hearing was held at 9:15 a.m. on the application was received from Glenn Martin Davis, Sr., representing the Tailgate Market for a Class A Beer and Wine License. Mr. Martin was in attendance.

Commissioner Fithian read the notice of public hearing into the record.

Mr. Stetson reported that Mr. Davis had been fingerprinted and application was in order. He advised that Mr. Davis was scheduled to attend the next alcohol awareness class.

Mr. Davis advised that the former Texaco gas station had been remodeled and would now be a sandwich shop and convenience store. Commissioner Beck inquired as to the hours of operation. Mr. Davis reported that the hours of operation may change, however, currently the establishment is open 6:00 a.m. to 8 p.m. and 8:00 a.m. to 5:00 p.m. on Sundays.

Commissioner Fithian asked if there was anyone who wished to speak for or against this application. Mr. Basil Wadkovsky, Esq., representing Country Liquors owner and licensee, Rajendra Desai stated that he wished to speak in opposition to this application. Country Liquors Manager, Mr. Patel, was also in attendance. On behalf of Country Liquors, Mr. Wadkovsky advised of concerns relating to approval of another convenience store located in Millington having a negative impact on Country Liquors business. He also alleged that the location of proposed license had inadequate parking, and alleged that there were five liquor licenses already established in the small town of Millington. Commissioner Newnam expressed his opinion that Planning and Zoning would address parking concerns. Mr. Stetson stated there exists three licensed premises within the Town of Millington; Country Liquors (Off Sale Only license) Millington Pizza (Restaurant License) and the Waterhole (Tavern license); Howard Johnson's (Restaurant license) is located on the outskirts of the Town.

Mr. Davis advised that all permits had been obtained and approved by Planning and Zoning Administration and on premise parking was available. A motion was made by Commissioner Newnam, seconded by Commissioner Fithian and passed by the majority of the

Board to approve the license. Commissioner Beck stated he was in favor of free enterprise, however, did not vote to approve the license.

This hearing was taped for reference and adjourned at 9:30 a.m.

RENEWAL APPLICATIONS

Mauritz Stetson, Alcoholic Beverage Inspector, appeared and reviewed 10 renewal applications. He reported he performed a percentage check (60% -40% food - alcoholic beverage sales ratio) and that in follow-up from last week's discussion relating to J.T.'s Rock Hall Inn, the only outstanding establishment not to meet the requirement was Great Oak Landing Restaurant. Commissioner Fithian advised that the Mears Great Oak Landing owners were cognizant of noncompliance and reported that the requirement would be met with the replacement chef/restaurant manager.

At the recommendation of Mr. Stetson, a motion was made by Commissioner Beck, seconded by Commissioner Newnam and made unanimous by Commissioner Fithian to approve the renewal applications, as presented.

There being no further business to claim their attention, the Board adjourned to meet again on Wednesday, November 6, 2002.
