The following items must be submitted to obtain a residential building permit for construction, additions, structural alterations or structural repairs of new or existing buildings and structures:
(Note: All one and two family dwellings, additions or alterations shall comply with the Council of American Building Officials (CABO) One and Two Family Dwelling Code, 1992 Edition, and do not require the services of a registered architect.)
Instructions for filling out a building permit application
You can either obtain an application at the Planning and Zoning Office or click to obtain a permit application form. When filling out the application, please print clearly or type in the information.
- OWNER'S NAME: Fill in the current property owner's name, address and telephone number. If you are a contract purchaser, the permit cannot be issued until the property transfers.
- If you plan to purchase the property and fill out the application in your name, you will need a signed letter from the current owner authorizing you to submit the application. A copy of the contract is also sufficient to process a permit.
- If you are a contractor submitting an application for the owner, you will need a signed letter from the owner authorizing you to submit the application.
- PROPERTY LOCATION: Provide the street name, election district, tax map, parcel number, lot number, acreage, and deed reference. All of this information is included on your tax bill and is also available from the assessment office. (410-778-7447).
- PROPOSED WORK: Clearly describe what is being built, i.e., single family dwelling; single family dwelling with attached garage and deck; apartment; addition with one bedroom and bath; pool; deck; shed; etc.
- MARKET VALUE: Fill in the value of the construction after it is completed.
- SETBACKS: Indicate the distance from the proposed dwelling to all property lines, the well and septic, and mean high tide, if applicable. If trees are to be removed, measure the square footage of the area being removed. If your property is located in the Critical Area, these trees must be replaced. Click here for a Critical Area Forest Clearing or Buffer Clearing Plan form. If in the Critical Area, please indicate the percent slope at the site where construction is proposed.
- NOTE: Setbacks are measured from the edge of overhangs or outermost portion of the building. Every part of a required yard shall be open to the sky, except as authorized by this Article, and except ordinary projections of sills, belt courses, window air conditioning units, chimneys, cornices, and ornamental features which may project to a distance not to exceed 24 inches into a required yard but NOT into a required buffer or stream protection corridor.
- IMPERVIOUS SURFACE AREA: Fill in (in square feet) the proposed and existing impervious surface on the property. Impervious surfaces are areas that water won't go through, such as buildings, paved driveways, sidewalks, patios, swimming pools, etc. Click here for a worksheet on calculating your impervious area.
- TYPE OF CONSTRUCTION: Check the type of construction.
- DIMENSIONS: Provide the dimensions for all new construction.
- HEIGHT OF STRUCTURE: Provide the height of the structure.
- IMPROVEMENTS: Check any improvements that are appropriate to the new construction.
- SEWAGE FACILITIES: If the property is currently served by a private system, the Environmental Health Department must review the existing sewage disposal system design. Additional sewage system capacity may be required based on the building plan.
- If you have any questions concerning these requirements, please contact the Kent County Environmental Health Department (410-778-1361).
- If a community or public sewage system is proposed, approval from the Department of Water and Wastewater Services for sewage hookup is required. Applications for hookup and appropriate fees must be submitted to the Dept. of Water and Wastewater Services, 709 Morgnec Road, Chestertown, MD 21620 (410-778-3287). Approval must be submitted to the Kent County Health Department before receiving its approval.
- TYPE OF WATER SUPPLY: If a private well is proposed, a licensed well driller must obtain a well construction permit. The permit application and appropriate fees should be submitted to the Kent County Health Department, P.O. Box 359, Chestertown, MD 21620 (410-778-1361).
- BEDROOMS: Fill in the number of bedrooms.
- BATHROOMS: Fill in the number of bathrooms.
- ENTRANCES: Check the type of road on which your entrance will be located. If the entrance is to be located on a County Road, you must contact the Kent County Roads Department, 709 Morgnec Road, Chestertown, MD 21620 (410-778-4252) to obtain an application for approval.
- If the entrance is to be located on a State Road, approval is needed from the State Highway Administration (410-778-0818).
- LEAD-SAFE WORK: If your property is a rental property, the following note will be added to your permit: “Please be advised that there is a presumption of lead-based paint in properties constructed prior to 1950. Protect workers and tenants by using the lead-safe work practices found in the Code of Maryland Regulations Section 26.02.07.”
- Many homes built before 1978 were painted using lead-based paint. Lead-based paint is particularly dangerous if it is chipping or peeling. If your home has chipping paint and this paint is lead-based, it places young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems and impaired memory. Lead poisoning also poses particular risk to pregnant women. It is recommended that you employ lead-safe work practices for any renovations or alterations. - CEMETERIES: If your property has a private cemetery, please locate it on the site plan.
- CONTRACTORS: Fill in the builder along with the license number and telephone number; plumber along with the license number and telephone number; electrician along with the license number and telephone number; and HVAC contractor along with the license number and telephone number.
- PLEASE NOTE THAT THE FIRST INSPECTION WILL NOT OCCUR WITHOUT THE ABOVE INFORMATION ON THE PERMIT
- SIGNATURE: Sign the application and print or type your name, address and telephone number.
After all applicable agencies have approved the plans, you will receive a permit.
Instructions for a permit site plan
The site plan should be submitted on a separate sheet, with the drawing legible and drawn to scale (1 inch = 40 feet) and must clearly indicate the following:
- Size, shape and dimensions of property
- Location and dimensions of proposed structures
- Distance from the proposed structure to all property lines, well, and septic system
- Location of driveway
- Easements/buffers if applicable
- Road names and abutting right-of-ways
- Floodplain limits, if applicable
- Distance from tributary streams and non-tidal wetlands
- Development on adjacent property
If your property is located within the Chesapeake Bay Critical Area, the following must be included on the site plan:
- All required buffers
- Areas with slopes in excess of 15%
- Distance to mean high tide - the edge of tidal wetlands or tributary streams
- Trees to be removed and area for reforestation
- All impervious surfaces - paved driveways, buildings, pools and paved or concrete walks
Building Plan Checklist
Submit two complete sets (three for additions/renovations) of the Building Plan that include:
Foundation Plans that Show:
- Shape and dimensions of the foundation wall
- Location and size of the girder beams, support posts and piers
- Floor joist sizes, spacing, direction, support, solid-blocking under bearing partitions
- Grade and species of all lumber to be used
Floor Plans that Show (For Each Floor Area):
- Use of all rooms (areas) and dimensions of all rooms (areas)
- Location of plumbing fixtures, hot water tank, appliances, cabinets and smoke detectors
- Access to attic space (minimum framed opening not less than 22" x 30")
- Location and dimension of all windows, doors and header sizes. Every sleeping room shall have at least one operable window or exterior door approved for emergency egress or rescue
- Size, direction, spacing and support of ceiling joists and beams
- Plan view of fireplace, hearth and furniture location, flue sizes, chimney construction, materials, clearance from combustible materials, height above roof and lateral support
- Grade and species of lumber
Structural Cross Section Drawings That Show:
- Footing sizes, foundation wall thickness, and maximum fill against wall. Bottom of footing must be 24" below grade
- Start and finish grades
- Bearing posts sizes (metal or wood), perimeter and pier footing sizes, and girder beam sizes
- Sill plates/sole plates and anchorage method. Allow 8" clearance from sill plate to earth. Pressure treated sill plate course required and FHA cap for top masonry
- 12" minimum from wood girder or post supporting girder to the ground for crawl spaces, and 18" minimum clearance under floor joists
- Size and spacing of floor joists and ceiling joists
- Size and spacing of studs and roof rafters, noting maximum span of rafters and method of bracing to bearing partitions (All trusses are to be engineered stamped by an approved certified agency and stress analysis and joint details must be submitted when requested.)
- Sheathing, covering of roof and walls, floor and ceiling
- All “R” values of insulation installed in the ceilings, walls, floors or the perimeter and on all ducting
Elevation Views Showing the Following:
- Front, rear, right and left elevations and final grades
- Roof overhangs and chimney clearances
- Type of exterior siding and roof covering
- Location of windows and exterior doors
Note: ALL DRAWINGS SHALL BE DRAWN TO SCALE (e.g. ¼” = 1 FOOT).
