License Commissioners met today with the following present: Roy W. Crow,
Scott D. Livie, and William W. Pickrum, presiding. Mauritz Stetson, Alcoholic Beverage Inspector, and Susanne Hayman, County Attorney, were also in attendance. SPECIAL LICENSE The Commissioners approved a one-day only Class C, Beer and Wine License for the Chestertown Wildlife Exhibition and Sale at the Emmanuel Parish Hall, Chestertown, on October 15, 2004. VIOLATION HARBOR HOUSE In response to a report dated September 21, 2004, received from the Alcoholic Beverage Inspector relating to an alleged violation of the Alcoholic Beverage Laws, i.e. Article 2B, Section 13-101, (2) of the Annotated Code of Maryland (failure to have an individual certified in alcohol awareness training on the premises during the hours in which alcohol beverages may be served or consumed), an administrative hearing was held at 9:30 a.m. Elizabeth Patnovic, of Chestertown, a licensee and an owner of the Harbor House, was also in attendance. Thomas Yeager, County Attorney, was not able to attend the hearing; therefore, Mr. Stetson and Mrs. Patnovic were sworn in by Ms. Hayman, Esq. for giving testimony. Mr. Stetson reported that during a routine inspection on September 17, 2004 at approximately 7:30 p.m., he entered the Harbor House Restaurant, of Chestertown. Mr. Stetson testified that he is familiar with the names on the list of employees certified in alcoholic awareness and was able to recognize that there were no employees present on the premises that were certified or properly logged-out, and also was told by an employee, present at the time of inspection, that there were none. As a result of the inspection, Mr. Stetson reported that there was probable cause to believe that a violation of the alcoholic laws had occurred. He also reported that this is the second violation of Article 2B, Section 13-101 for the Harbor House restaurant. On November 6, 2001, the establishment was found not to have a certified person on the premises. The previous Board decided that because of the newness of the law at that time, John R. Patnovic, also a licensee and an owner of Harbor House, was given a written reprimand which was maintained in his file. Mrs. Patnovic then testified and reported that both she and her husband have taken their responsibilities as licensees very seriously ever since they became owners of the Harbor House restaurant and marina in 1997. She did not dispute Mr. Stetson's testimony. Mrs. Patnovic indicated that she was on the premises, however, not on the licensed premises, and she gave assurance to the Board that the violation would not occur again. She advised that the restaurant manager has three employees enrolled in the next alcohol awareness class. She also noted that the Harbor House is a seasonal business and is open only from 5:00 p.m. to 8:00 p.m. Commissioner Pickrum requested a recess for counsel 9:40 a.m. The Commissioners resumed the hearing at 9:42 a.m. Commissioner Pickrum indicated that the Board found the Harbor House restaurant to be in violation of Alcoholic Beverage Laws and levied a fine of $100.00 which was suspended. This hearing adjourned at 9:43 a.m. There being no further business to claim their attention, the Board adjourned to meet again on Tuesday, October 12, 2004, at 8:30 a.m. in the Commissioners' Hearing Room.
