The Honorable Board of License Commissioners met today with the following present: Roy W. Crow, Scott D. Livie, and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, was also in attendance.

VIOLATION
TAILGATE MARKET

In response to a report dated May 27 received from the Alcoholic Beverage Inspector relating to an alleged violation of the alcoholic beverage laws Article 2B Section 13-101(2)(i), of the Annotated Code of Maryland as to failure to have an individual certified in Alcohol Awareness Training present during the hours in which alcoholic beverages are served or consumed, an administrative hearing was held at 9:40 a.m in the Commissioners Hearing Room.. Susanne Hayman, County Attorney, was in attendance as well as Mauritz Stetson, Alcoholic Beverage Inspector, and Glenn Martin Davis, Licensee.

Mr. Stetson and Mr. Davis were sworn in by the County Administrator for giving testimony. Mr. Stetson reported that during routine inspection on May 23, he observed the only employee on duty who was not certified in alcohol awareness training. He reported that Mr. Davis returned from the bank and had forgotten to log out. Mr. Stetson advised that Mr. Davis was cited for a similar violation in December 2002.

Mr. Davis advised that one of his employees had recently quit without giving notice and he was busy performing extra duties and forgot to log out. Commissioner Pickrum inquired if the employee had received training. Mr. Davis reported that there has not been an alcohol awareness training class available since he hired his new employee, however, she will attend the next scheduled class. He noted that he does have two other employees trained who work evenings and weekends. Mr. Davis presented his log book which confirmed his compliance with the State regulations. Commissioner Livie stated that it seemed to be more of a matter of timing with this particular incident. Commissioner Crow concurred. A motion was made by Commissioner Crow, seconded by Commissioner Live and made unanimous by Commissioner Pickrum to levy a $50.00 fine.

This hearing was taped for referenced and adjourned at 10:00 a.m.

SPECIAL LICENSE

The Commissioners approved a one day special Class C Beer License for Gilchrest for Congress Committee to hold a fund raising event on July 19 at Turners Creek.

VIOLATION
WATERMAN'S CRAB HOUSE

The Alcoholic Beverage Inspector notified the Commissioners and provided a report documenting that a violation of the alcoholic beverage laws (furnishing or allowing underage consumption of an alcoholic beverage 10-118, and underage possession of an alcoholic beverage 10-114) took place on June 21 at Waterman's Crab House in Rock Hall. The case was closed by arrest and juvenile citation. The licensee of this licensed premise was not involved in this violation.

There being no further business to claim their attention, the Board adjourned to meet again on Tuesday July 8, 2003.
