KENT COUNTY, MARYLAND

The Honorable Board of License Commissioners met today with the following present:Roy W. Crow, Scott D. Livie and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, appeared to discuss the following issues:

SPECIAL LICENSE

The Commissioners approved the following special Licenses:

A Class C Beer License for Triangle Club for the Bigwoods Annual Picnic to be held at Bigwoods Park, Worton, on August 31.

A Class C Beer License for the Chestertown Jazz Festival at Wilmer Park on

September 6.

A Class C Beer and Wine License for Mainstay Inc., for a music event to be held at the Mainstay building, Rock Hall, on September 7.

VIOLATION
ANDY'S

In response to report dated July 8 received from the Alcoholic Beverage Inspector relating to an alleged violation of the alcoholic beverage laws Article 2B Section 12-108, of the Annotated Code of Maryland, service to a person under the age of twenty-one and Article 2B Section 6-401, of the Annotated Code of Maryland, a person under the age of twenty-one in a Kent County Class "D" establishment, an administrative hearing was held at 9:45 a.m in the Commissioners Hearing Room. Susanne Hayman, County Attorney, was in attendance as well as Mauritz Stetson, Alcoholic Beverage Inspector, Louise Goddard, licensee and Ann W. Sparks, witness.

Mr. Stetson, Ms. Goddard and Ms. Sparks were sworn in by Ms. Hayman for giving testimony. Per his report dated July 8, 2003, Mr. Stetson reviewed the events of June 28 and identified young people under the age of twenty-one consuming alcoholic beverages in Andy's. Ms. Sparks, wait staff, testified that she did not card the individuals as she believed they were older than twenty-one. Ms. Goddard testified that the establishment was in error and does not want to serve underage people.

Ms. Hayman advised of a similar incident in 1997 resulting in a one day suspension of the alcoholic beverage license and noted the possible associated fines and suspensions for a second offense.

Commissioner Livie recommended $100 fine and one day suspension to be waived. A motion was made by Commissioner Livie, seconded by Commissioner Crow and made unanimous by Commissioner Pickrum to impose $100 fine and waive the one day alcoholic license suspension with the stipulation that Andy's does not have another similar violation in the next three years.

The hearing was taped for reference and adjourned at 10:05 a.m.

ALCOHOLIC BEVERAGE RULES AND REGULATIONS

Mr. Stetson forwarded changes to the Alcoholic Beverage Rules and Regulations. The changes included the addition of Special Wine Privilege and a text change relating to the Class B restaurant license report. The Commissioners stated of their desire to review the changes and address the matter at a later date.

SUDS-N-SODA

An application for a transfer of a Class A Beer, Wine and Liquor License was received from Alpaben R. Patel, President, et al representing Neel, Inc. A public hearing is scheduled for September 16 at 9:45 a m.

There being no further business to claim their attention, the Board adjourned to meet again on Tuesday September 2, 2003.
