KENT COUNTY, MARYLAND

The Honorable Board of License Commissioners met today with the following present: Roy W. Crow, Scott D. Livie, and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, was also in attendance.

C-TOWN LIQUORS & DELI

Correspondence was sent by Mauritz Stetson, the County Alcoholic Beverage Inspector, to John Krastel, President, JC's Liquors & Deli, Inc., notifying Mr. Krastel of an alleged violation of Article 2B, Section 13-101 (2) of the Annotated Code of Maryland and that under the provisions of said Code, there will be an administrative hearing on Tuesday, September 23, 2003, at 9:45 a.m. It was alleged that at the time of Mr. Stetson's inspection, there were no employees on the premises of C-Town Liquors & Deli trained in Alcohol Awareness or properly logged out.

SUDS-N-SODA

A public hearing was held at 9:55 a.m. on the application received from Alpaben R. Patel, President, and Robert A. Girmscheid, Jr., Vice-President, representing Neel, Inc. for a transfer of a Class A Beer, Wine and Liquor (off sale only) License. Mrs. Patel, Mr. Girmscheid, and their attorney, Basil Wadkovsky, were in attendance.

Commissioner Pickrum read the notice of the public hearing into the record.

Mr. Stetson reported that a Class A License has been in place at that location for almost 20 years and that he has met with Mrs. Patel and Mr. Girmscheid and reviewed the previous records regarding the business, noting that there is no history of any infringement of the law. Mr. Stetson further reported that both of the above individuals have been finger-printed and that Mrs. Patel has enrolled herself and other employees in the Alcohol Awareness Class. The current business operations of Suds-N-Soda are the same as the previous business operations on that site, including the same hours of operation.

Commissioner Livie strongly encouraged all of the employees of the business to enroll in the Alcohol Awareness Class and to learn to properly log in and out. He also pointed out that the Commissioners are very concerned about the attempts made by the underaged to purchase alcoholic beverages in the County, and, therefore, encouraged the owners to properly police their customers.

Mrs. Patel assured Commissioner Livie that she regularly checks for underaged customers. Commissioner Pickrum concurred with Commissioner Livie that there is a significant number of the County's youth engaged in attempts to purchase tobacco products and alcoholic beverages. Mr. Wadkovsky reported that his client, Mrs. Patel, can be trusted to be diligent in enforcing the laws at her business.

There was not anyone in attendance who wished to speak for or against this application.

A motion was made by Commissioner Crow, seconded by Commissioner Livie and made unanimous by Commissioner Pickrum to approve this application contingent upon receipt of the Bulk Transfer Permit.

This hearing was taped for reference and adjourned at 10:00 a.m.

There being no further business to claim their attention, the Board adjourned to meet again on Tuesday, September 23, 2003.
