Kent County Board of License Commissioners 10/28/2003

KENT COUNTY, MARYLAND

Board of License Commissioners

October 28, 2003

The Honorable Board of License Commissioners met today with the following present: Roy W. Crow, Scott D. Livie, and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, was also in attendance.

RENEWAL APPLICATIONS

Mauritz Stetson reviewed 28 renewal applications. He reported that he performed a percentage check (60% - 40% - alcoholic beverage sales ratio) on Class B alcoholic beverage license applications, and the only establishment not to meet the requirement was Great Oak Landing Restaurant. Mr. Stetson pointed out that Great Oak Landing Restaurant did not comply with the requirement in 2002, and noted that part of the problem with their non-compliance is the inclusion of the Jelly Fish Joel's bar which is part of the Great Oak business and is included in the same license. Only 15% of the bar's business is food.

Commissioner Pickrum replied that the management of Great Oak must rectify its non-compliance and obey the law as must all the other owners. Commissioner Livie concurred, stating that Great Oak must solve its problem or be down-graded.

A motion was made by Commissioner Crow, seconded by Commissioner Livie, and made unanimous by Commissioner Pickrum to approve the renewal applications as presented with the exception of Great Oak Landing Restaurant to whom will be given a conditional renewal and will be given 30 days to present a written plan which will indicate how they will rectify their failure to meet the 60%-40% ratio requirement in order to maintain their Class B License.
