The Honorable Board of License Commissioners met today with the following present: Roy W. Crow, Scott D. Livie, and William W. Pickrum, presiding.

Mauritz Stetson, Alcoholic Beverage Inspector, was also in attendance.


VIOLATION
MILLINGTON PIZZA


An Administrative Hearing was held at 9:30 a.m. in the Commissioners' Hearing Room. Anna D. Pectelidis, Licensee, and Thomas Yeager, County Attorney were also in attendance.

Mr. Stetson and Mrs. Pectedlidis were sworn in by Mr. Yeager for giving testimony.

Mr. Stetson indicated that it is alleged that on Sunday, May 24, 2004, at approximately 3:30 p.m., he entered Millington Pizza in order to conduct a routine alcohol and tobacco inspection and, based on his observations and questioning of two employees present, concluded that there was probable cause for the violation of the Alcoholic Beverage Laws (failure to have an individual certified in Alcoholic Beverage Awareness Training on the premises during the hours in which alcoholic beverages may be served or consumed ), Article 2B, Section 13-101(2)(i), of the Annotated Code of Maryland, and he concluded that there was probable cause that Mrs. Pectedlidis had not properly logged out when she left the premises at approximately 12:00 noon earlier that day.

Mr. Stetson reported that he, on the day of the alleged violation, suspended the sale of alcoholic beverages at Millington Pizza until a certified person was present.

Mrs. Pectedlidis testified that she was aware that one of the employees working on the premises at the time of the alleged violation, Eva Coleburn, was certified in the State of Delaware. Mrs. Pectedlidis also indicated that she did not know that her employee's certification had to be issued by the State of Maryland.

Mr. Stetson reported that, in his opinion, he states very clearly in his Alcohol Awareness Classes that certification of employees of establishments in Maryland that sell or serve alcoholic beverages must be issued by the State of Maryland.

Mrs. Pectedlidis reported that the reason she did not log out was because she was under the impression that Mrs. Coleburn was appropriately certified.

There being no further testimony, the Commissioners recessed with Counsel in order to deliberate.

Following the recess, Commissioner Livie initiated the disposition by stating that it was the decision of the Board that Millington Pizza was in violation of the Alcoholic Beverage laws.

A motion was made by Commissioner Livie, seconded by Commissioner Crow, and made unanimous by Commissioner Pickrum to impose the maximum fine of $100.00 and to suspend the same fine of $100.00, placing Millington Pizza in a probationary period.

Commissioner Livie emphasized to Mrs. Pectedlidis that the decision of the Board was not a free pass and that any further violation would be treated with much greater severity.


This hearing was taped for reference and adjourned at 9:45 a.m.


VIOLATION

A report was received from Mr. Stetson concerning the violation of the Alcoholic Beverage Laws [misrepresenting age to gain entrance to a Class D Establishment (Article 2B, Section 6-401(p)]. The violation occurred at the Blue Bird Tavern, Chestertown.

The case was closed by an arrest.


SPECIAL LICENSE

The Commissioners approved a one-day-only, Class C, Beer License for a fund-raising event of the organization, "Gilchrest for Congress" to take place at the Turner's Creek Pavilion on July 17, 2004, and a one-day-only, Class C, Beer, Wine and Liquor License for the Chestertown Volunteer Fire Company Auxiliary for an event to be held on June 29.


WASHINGTON COLLEGE

Correspondence was received from H. Louis Stettler, III, Senior Vice President for Finance and Management, requesting that Bryan L. Matthews', Director of Athletics, name replace Maureen K. McIntire's name on Washington College's Alcoholic Beverage License.


There being no further business to claim their attention, the Board adjourned to meet again on Tuesday, July 6, 2004.

There will be no regular meeting on June 29.
