The Honorable Board of License Commissioners
met this evening at 6:00 p.m. with the following present: Roy W. Crow,
Scott D. Livie, and William W. Pickrum, presiding.
THE BOARD OF LICENSE COMMISSIONERS
The Board of License Commissioners decided not to meet during the week
of November 21, 2004.
SPECIAL LICENSE
The Commissioners approved the following one-day-only, Class C Licenses:
a Beer License for the Betterton Still Pond Lions Club for its fund-raising
event to take place at the Betterton Fire Hall, Betterton, on November
13, 2004; a Beer, Wine, and Liquor License for the Rock Hall Volunteer
Fire Department-Kent and Queen Annes County Fire and Rescue for their
event at the Rock Hall Civic Center and Fire House on November 13; and
three, one-day-only, Class C, Beer and Wine Licenses for the Mainstay,
Inc., of Rock Hall, for musical events to take place at the Mainstay building
at 5753 Main Street, Rock Hall on the following dates: November 11, 21,
28, 2004.
KENNEDYVILLE INN
A public hearing was held at 6:30 p.m. on the application received from
Jason Thomas Hopewood, Operating Partner, Glenn B. May III, Operating
Partner, Barbara H. Silcox, Silent Partner, all representing Poor Chefs,
LLC, for a the transfer of a Beer, Wine, and Liquor (Special Sunday Privilege)
License Class B, (On sale) from Bake, Inc.
Messrs. Hopewood and May and Ms. Silcox, as well as Kevin McKinney, current
licensee, were in attendance, as well as seven interested persons and
a member of the media.
Commissioner Pickrum read the notice of the public hearing into the record.
Mr. Hopewood indicated that he and Mr. May are experienced in the restaurant
business and are trained chefs, and he reported that the restaurant has
been open under their supervision for 2 weeks, with the alcoholic beverage
license under the names of Mr. McKinney and that Mauritz Stetson, Alcoholic
Beverage Inspector, had conducted an inspection on the premises.
According to a written report, dated November 2, submitted to the Board
of License Commissioners by Mauritz Stetson, both Messrs. Hopewood and
May have been fingerprinted and have attended the on-premise class in
alcohol awareness training on October 20. Mr. Stetson noted that Ms. Silcox,
wife of the current licensee, will be on the license as the Kent County
resident until the new owners establish their residence for the required
two years.
In his report, Mr. Stetson indicated that in the conversations with the
two owners, he learned that they intend to keep the operation and menu
of the business as it had been under the previous owners. He also noted
that he has never observed any violations occurring on the premises of
the Kennedyville Inn, and he recommended to the Commissioners that a transfer
of a Beer, Wine and Liquor (Special Sunday Privilege) Class B License
for the premises which trades as the Kennedyville Inn.
There was no one in attendance who wished to speak for or against this
application.
A motion was made by Commissioner
Crow, seconded by Commissioner Livie, and made unanimous by Commissioner
Pickrum to approve the transfer of license as requested contingent upon
approval of the State Bulk Transfer Permit.
The Commissioners wished Messrs. Hopewood and May well with their new
business venture, and emphasized the seriousness of the responsibilities
which they will have as licensees, as well as the seriousness with which
the Board deliberates concerning violations of the Alcoholic Beverage
Laws.
Commissioner Livie noted that the most frequent violation made by licensees
has been the failure to have employees on the premises who are certified
in alcohol awareness training.
Commissioner Pickrum noted that the highest rate of use of alcoholic beverages
by minors in the State is represented by Kent County.
Commissioner Livie praised Mr. McKinney and Ms. Silcox for their work
in providing the County with a valuable community restaurant.
This hearing was taped for reference and adjourned at 6:40 p.m.
There being no further business to claim their attention, the Board adjourned
to meet again on Tuesday, November 16 at 8:30 a.m.
